Please read these Part Time Pilot™ Terms and Conditions carefully before using the www.parttimepilot.com website (the “Service”) operated by Part Time Pilot™ (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or otherwise use the Service.

By accessing or using the Service you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms then you do not have permission to access the Service.

Communications

By creating an Account on our service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send. Cancelled subscriptions will be terminated upon request promptly. 

SMS Communications

By providing your phone number and opting in to receive SMS messages from Part Time Pilot™, you consent to receive text messages related to your account, training progress, platform updates, and occasional promotional or informational messages regarding our services.

Types of messages you may receive include, but are not limited to:

• Account alerts and notifications

• Course updates and reminders

• Training tips or aviation learning resources

• Promotional or informational messages related to our services

Message frequency may vary depending on your interaction with our platform and services. Message and data rates may apply according to your mobile carrier’s messaging plan. You may opt out of SMS communications at any time by replying STOP or UNSUBSCRIBE to any SMS message you receive from us. After opting out, you will no longer receive SMS messages unless you opt in again.

If you need assistance with SMS communications, you may reply HELP to any message or contact our support team at team@parttimepilot.com.

We reserve the right to modify or discontinue SMS messaging services at any time.

Purchases

If you wish to purchase any product or service made available through the Service (“Purchase” or “Checkout”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

The service may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, failure of payment, an error in your order, or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

We offer a 100% money back guarantee if and only if you fail the FAA Knowledge Exam after receiving an endorsement from Part Time Pilot™ for the same test that you failed within 21 days of receiving your endorsement from us. Students that wait too long to take the test after our endorsement process are likely to lose knowledge needed for the course.  Therefore, in order to get a 100% refund of your purchase for either our Sport Pilot Online Ground School, Private Pilot Online Ground School or our IFR Online Ground School, you must take the FAA written/knowledge exam that corresponds with that course/endorsement at a certified FAA testing center not less than 21 days from receiving your endorsement from Part Time Pilot™, fail the test, and be able to provide proof of failure to Part Time Pilot™. The 100% money back guarantee is a guarantee for the effectiveness of the course. If you never take the FAA Sport Pilot, Private Pilot or IFR Written Exam then you will not be able to receive a money-back guarantee. Refunds

Refunds are available for Part Time Pilott™ Online Ground School, Checkride Prep and any bundle of courses which are one-time payments if and only if the customer has not completed over 50% of any single course in their membership AND has not downloaded any of the downloadable content AND it has not been more than 180 days since they purchased the Part Time Pilot™ product. 

There are no refunds for Part Time Pilot™ VIP, Live Online Ground Schools or any other product that includes live lessons. 

There are no refunds for Part Time Pilot™ subcription products such as our Interactive AI Tools subcriptions or any other recurring payment subscription model products.

Getting an FAA Endorsement

The decision to provide a signed endorsement to take the Private Pilot, Sport Pilot, Recreational Pilot, or IFR Pilot FAA Knowledge Exam by myself, Nick Smith, is completely dependent upon whether or not the student follows the necessary recommendations. Part Time Pilot’s™ initial assessment of a student’s endorsement status will include the average score of their first attempt at 3 practice tests. However, Part Time Pilot™ may determine that more tests or more studying and improvement needs to occur before they give the student’s endorsement. If a student does not follow the recommendations of Part Time Pilot then Part Time Pilot™ may withhold providing an endorsement. 

Instructor Access

Part Time Pilot™ will allow and create flight instructors a free instructor account if and only if they meet the following conditions:

• The flight instructor provides their FAA certificate number to Part Time Pilot™ which allows Part Time Pilot™ to verify using FAA resources that the instructor has a current and valid flight instructor certificate in the United Stated under Federal Aviation Regulations
• The flight instructor provides an email of one of their students who is enrolled in a paid Part Time Pilot™ online ground school to Part Time Pilot™ and Part Time Pilot™ verifies the enrollment of that student
• The flight instructor’s certificate matches the course they are requesting access to and the course their student is paid and enrolled into. For example, the instructor is certified to flight instruct Private Pilot certificates and the flight instructor provides the email of a student who is enrolled in the Part Time Pilot™ Private Pilot online ground school

An instructor may not, at any time, use any Part Time Pilot™ content of any sort or medium for profit. An instructor may not, at any time, print, copy, download or share any Part Time Pilot™ content to anyone without the express written consent of Part Time Pilot™. If Part Time Pilot™ finds that an instructor has wrongly utilized their access to Part Time Pilot™ content, Part Time Pilot™ will take immediate legal action and the instructor’s access will be revoked. Furthermore, Part Time Pilot™ can remove an instructor’s access at any point, for any reason. 

Affiliate Program

The affiliate program is by invite only. Part Time Pilot™ has the full authority to deny or accept any affiliate for any reason. Once approved, an affiliate can make money when students use the affiliate’s custom referral link. If a student purchases, but does not use, the affiliate’s custom affiliate link, then the affiliate will not and cannot be credited with the referral sale. Therefore, the only way an affiliate can receive earnings is if a student signs up to any of our Online Ground Schools, Checkride Prep courses, or Bundle deals and the student has been tracked through the affiliates custom referral link that includes the affiliates ID. If a sale is not tracked in our system, the affiliate cannot receive a commission for the sale. Once a successful referral has been made, a percentage of the sale will be credited to the affiliate’s account according to the agreed upon percentage between the affiliate and Part Time Pilot™. Payouts will be made on a month delay to protect Part Time Pilot™ from refund fraud. If an affiliate receives a payout for a sale that is later refunded, Part Time Pilot will recollect the amount awarded to the affiliate. The affiliate will get paid if, and only if, they meet the requirements of the Payouts Service or PayPal and have successfully linked a valid bank account, debit card or PayPal account. If an affiliate is located in a country not supported by the Payouts Service or PayPal, the affiliate cannot collect their accredited referral earnings and Part Time Pilot™ will retain those earnings. If an affiliate does not meet the requirements of the Payout Service by linking a valid bank account or debit card within 90 days, Part Time Pilot™ will keep any earnings awarded to the affiliate and the affiliate will not be able to be paid any funds earned prior to 91st day as an accepted affiliate. Part Time Pilot™ is not obligated to continue the affiliate program for any specific set of time. Part Time Pilot™ can end the affiliate program or affiliate relationship with any affiliate at any time and for any reason. Part Time Pilot™ can change the affiliate commission rate at any point to any number Part Time Pilot™ deems necessary. 

Availability, Errors and Inaccuracies

We are constantly updating product and service offerings on the Service. We may experience delays in updating information on the Service and in our advertising on other web sites. The information found on the Service may contain errors or inaccuracies and may not be complete or current. Products or services may be mispriced, described inaccurately, or unavailable on the Service and we cannot guarantee the accuracy or completeness of any information found on the Service.

We therefore reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Contests, Sweepstakes and Promotions

Any contests, sweepstakes or other promotions (collectively, “Promotions”) made available through the Service may be governed by rules that are separate from these Terms & Conditions. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms and Conditions, the Promotion rules will apply.

Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness.

By posting Content on or through the Service, You represent and warrant that: (i) the Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. We reserve the right to terminate the account of anyone found to be infringing on any intellectual property.

You retain all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights. We take no responsibility and assume no liability for Content you or any third party post on or through the Service. However, by posting Content using the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce and distribute such Content on and through the Service. You agree that this license includes the right for us to make your Content available to other users of the Service, who may also use your Content subject to these Terms.

Part Time Pilot™ has the right, but not the obligation, to monitor and edit all Content provided by users.

In addition, Content found on or through this Service is the property of Part Time Pilot ™ or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.

Accounts

When you create an account with us, you guarantee that you are over the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

Intellectual Property

The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Part Time Pilot™ and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Part Time Pilot™.

Links To Other Web Sites

Our Service may contain links to third party web sites or services that are not owned or controlled by Part Time Pilot™.

Part Time Pilot™ has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that Part Time Pilot™ shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third party web sites or services that you visit.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, within our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you must discontinue using the Service.

All provisions of the Terms, which by their nature should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Indemnification

You agree to defend, indemnify and hold harmless Part Time Pilot™ and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

Limitation Of Liability

In no event shall Part Time Pilot™, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Part Time Pilot™ its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

Governing Law

These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

AI Features

Part Time Pilot™ does not own the AI software but simply utilizes the AI models developed by other companies. Part Time Pilot™ utilizes these AI models from other companies and combines them with a list of embedded prompts. Part Time Pilot™ may also provide FAA and other official documentation as context for these AI chatbots. Therefore, Part Time Pilot™ is in no way responsible for anything the AI Chat speaks, writes or does in response to a user prompt. Furthermore, the AI Chat does not represent Part Time Pilot™ nor does it speak for Part Time Pilot™. Therefore, any decisions, deals, agreements or contracts made through the AI chat are not legally binding. Nothing the AI chat that Part Time Pilot™ utilizes is legally binding in any way. If any deals, decisions, agreements or contracts are to be made with Part Time Pilot™ they must be made directly with the owner of Part Time Pilot™, Nick Smith. Finally, Part Time Pilot™ is not responsible for any actions a user takes based upon the information provided in any of these chatbots. Users should always consult with applicable experts before acting on any information.

AI Tools Fair Use Policy

Certain features within the Service may utilize artificial intelligence, machine learning models, voice simulation, or other usage-based technologies (“AI Tools”). Access to AI Tools is provided for individual educational use only and is subject to this Fair Use Policy. To ensure reliable performance, sustainability, and equitable access for all users, AI Tools may be subject to reasonable rolling usage limits, including but not limited to:

• Limits on the number of queries, sessions, messages, or voice interactions per day or per month

• Rate limits on requests

• Token, processing, or compute limits

• Restrictions on automated, scripted, or bulk usage

• Prohibitions on commercial, account sharing, resale, or redistribution use

Use of AI Tools must be consistent with normal personal study and training purposes. Excessive, abusive, automated, exploitative, or commercially oriented usage is strictly prohibited. We reserve the right, in our sole discretion, to monitor usage patterns, implement technical limitations, throttle, suspend, or restrict access to AI Tools, require upgrade to a subscription plan for continued access, or terminate access for violations of this Fair Use Policy.

Access to AI Tools may depend on third-party service providers and infrastructure. Availability, performance, and features are not guaranteed and may vary.

Service Modifications and Feature Changes

We reserve the right, at any time and in our sole discretion, to modify, suspend, replace, or discontinue any part of the Service, including but not limited to:

• Features

• Functionality

• Course components

• AI-powered tools

• Third-party integrations

• Pricing structures

Lifetime access purchases apply to the core educational content of the course as it exists at the time of purchase and as reasonably updated over time. Lifetime access does not guarantee perpetual availability of:

• Usage-based features

• AI-powered tools

• Third-party services

• Beta features

• Promotional inclusions

We may introduce new features that require additional fees or subscription plans. Continued use of the Service after modifications constitutes acceptance of those changes. Where required by law, we will provide reasonable notice of material changes. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of any portion of the Service.

Certified Ground Instructor

All the numbers and procedures used by Part Time Pilot™ content are based off common aviation trainer aircraft and are only to be used to help a student’s understanding of a maneuver or procedure. Any user of Part Time Pilot™ and their instructor must determine these numbers and procedures themselves using the approved flight manual or pilot operating handbook for the aircraft they are using to fly. 

Part Time Pilot™ and all of its content was created and maintained by myself, Nick Smith. I am a certified FAA ground instructor per FAR 14 CFR 61.215 with license issued on 08/21/2020. This license is kept current per FAR 143.19. I will use these FAA regulations to invoke the privileges of a basic ground instructor by providing endorsements for the FAA private pilot written test as well as providing ground instruction for students preparing for their private pilot FAA checkride.

While I am a certified Ground Instructor through the FAA, I am not a certified Flight Instructor. Your Flight Instructor should be the final word on all things regarding flight training. This course is meant to aid and prepare you for the written ground test, but if there are any disagreements in this course with how your flight instructor teaches a particular subject, maneuver or concept, you should follow your flight instructor’s direction. A Ground Instructor has the following privileges as described by FAR 14 CFR 61.215:

“A person who holds a basic ground instructor rating is authorized to provide –

(1) Ground training in the aeronautical knowledge areas required for the issuance of a sport pilot certificate, recreational pilot certificate, private pilot certificate, or associated ratings under this part;

(2) Ground training required for a sport pilot, recreational pilot, and private pilot flight review; and

(3) A recommendation for a knowledge test required for the issuance of a sport pilot certificate, recreational pilot certificate, or private pilot certificate under this part.”

Where the definition of “Ground Training” is “training, other than flight training, received from an authorized instructor” where “Flight Training” is “training, other than ground training, received from an authorized instructor in flight in an aircraft.”

This means I am legally allowed to assist you with all training, other than flight training in an aircraft. Any accidents or incidents that occur involving you in an aircraft are the responsibility of the pilot in command or any other party involved in the incident or accident. Part Time Pilot™ takes no responsibility of the actions you take while in or around an aircraft. Part Time Pilot™ only advises via ground instruction as acceptable per FAR 14 CFR 61.215.

Subscriptions

Certain features or services offered through the platform may be provided on a subscription basis. By purchasing a subscription, you agree that your subscription will automatically renew at the end of each billing period unless cancelled prior to the renewal date.

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will stop future billing, but access to the subscription features will continue until the end of the current billing period.

Unless otherwise stated, subscription payments are non-refundable once the billing period has begun. We do not provide refunds or credits for partial subscription periods or unused services. We reserve the right to modify subscription pricing, features, or usage limits with reasonable notice where required by law.

Request Your Account Deleted

Part Time Pilot™ users, at any time, can request that their account be deleted and that they stop receiving emails from Part Time Pilot™. An account deletion request will delete your access to any Part Time Pilot™ memberships (paid or free) and any mobile applications the user is enrolled in.
